The Office of the Insurance Commissioner is hosting a webinar for hospitals and providers to explain how the OIC intends to implement the dispute resolution/arbitration process included in the Balance Billing Protection Act (BBPA). WSHA, along with the Washington State Medical Association and other provider groups, advocated during the legislative process for a robust arbitration process.
The arbitration process is available when a state-regulated insurer and provider disagree on a commercially reasonable payment rate for applicable out-of-network services under the BBPA. The BBPA passed during the 2019 legislative session and effective January 1, 2020, prohibits hospitals and providers from balance billing patients for out-of-network emergency services and out-of-network services provided at an in-network facility. State-regulated insurers subject to the BBPA are required to pay a commercially reasonable rate for applicable out-of-network services.
