OIC Releases Stakeholder Draft of Surprise Billing Law Rules

On August 2, the Office of the Insurance Commissioner released stakeholder draft rules for HB 1065, the Balance Billing Protection Act passed during the 2019 legislative session. In general, we believe the draft rules are generally limited to clarifications to certain provisions of the act and do not add additional requirements.  WSHA is actively involved in the rulemaking process to ensure rules are reasonable for hospitals and do not significantly alter provisions of the bill that were specifically negotiated between facilities, providers, and carriers. WSHA will be attending the stakeholder meeting and submitting comments.   

 Comments to OIC on the draft are due August 16.  OIC is also hosting a meeting to obtain stakeholder input on Monday, August 12. Click here for link to the stakeholder draft and information regarding the stakeholder meeting and comment submission.  OIC indicated it plans to release the formal CR-102 notice and proposed rule early October with standard comment period and hearing.
