Department of Labor Considering Rulemaking on Overtime for Exempt Workers

WSHA recently published a bulletin describing the Washington State Department of Labor and Industries’ (L&I) rulemaking process and pre-proposal draft that could expand the class of workers who qualify for overtime pay. The proposed changes would reduce the number of Executive, Administrative and Professional (EAP) workers currently exempt from overtime by applying a potentially meaningful change to the minimum salary threshold and revising the job duties criteria. We encourage your hospital to engage now if you feel strongly about the pre-proposal.

L&I is in the latter stages of the pre-proposal phase, and is seeking feedback on its pre-proposal draft rule, available here. Comments are due by October 26, 2018. The next phase is a more formal rulemaking period. (Jaclyn Greenberg, jaclyng@wsha.org)
